Agreement

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and PURENUTRITION SRL, operating under the OO WELL™ brand and trademark ("OO WELL", "Company", "we", "our", or "us"), regarding your access to and use of the OO WELL™ mobile application (the "App") and related services.

By accepting these Terms upon first use of the App, you agree to be bound by them. If you do not agree with these Terms, you must not use the App.

Eligibility

The App is intended exclusively for individuals aged 18 years or older. Accounts are created directly by PURENUTRITION SRL for clients who have entered into a program agreement with the Company, following verification that the client is at least 18 years old. The App is not available for public self-registration and is not directed at children.

Accounts and Access

OO WELL™ is a private application provided to clients of PURENUTRITION SRL. Clients enter into a written program agreement (contract) with the Company. Based on that agreement, the Company creates an account for the client and prepares the client's diagnostic results, lifestyle and nutrition analysis, and interpretation of laboratory results (where provided) within the App.

When the client first downloads and opens the App, they are presented with these Terms, the Privacy Policy, and the applicable consents, which must be accepted before any content is accessed.

No Payments Within the App

The App does not process payments, subscriptions, or in-app purchases. Access to the App is provided to clients who have separately purchased a program, consultation, or service directly from PURENUTRITION SRL, outside of the App. The App itself is provided to eligible clients at no additional charge and contains no purchasable content, features, or subscriptions.

Description of Services

OO WELL™ provides wellness, lifestyle, nutrition, educational content, personalized wellness programs, specialist consultations, progress tracking tools, AI-powered guidance, and related services. The App may include:

Wellness assessments
Nutrition recommendations
Lifestyle recommendations
Wellness and educational content
Program tracking
Food logging and food photo uploads
Communication with specialists
Optional AI-assisted analysis of meal photographs (informational only, no advice)

OO WELL™ reserves the right to modify, suspend, or discontinue any part of the services at any time.

Wellness Disclaimer

OO WELL™ is not a medical institution, clinic, hospital, healthcare provider, or emergency service.

The App and all information provided through it, including consultations, assessments, AI-generated responses, educational content, recommendations, reports, and wellness programs, are intended solely for educational, informational, and wellness purposes.

Nothing within the App constitutes:

Medical advice
Medical diagnosis
Medical treatment
Prescription of medication
Emergency medical care

Users should always seek the advice of qualified healthcare professionals regarding any medical condition, symptoms, diagnosis, medications, treatment decisions, or emergencies. Users must not delay seeking medical care or disregard professional medical advice because of information received through the App. If you believe you are experiencing a medical emergency, contact emergency services immediately.

User Account Responsibilities

Users are responsible for:

Maintaining account confidentiality
Keeping login credentials secure
Ensuring information provided is accurate
Updating account information when necessary

Users are responsible for all activity occurring under their account. OO WELL™ may suspend or terminate accounts that violate these Terms.

User Content

Users may upload laboratory results, health-related documents, food photographs, messages, notes, and other information.

Users retain ownership of their content. By uploading content, users grant OO WELL™ a non-exclusive license to process, store, analyze, and use such content solely for providing the services. Users are solely responsible for content they submit.

AI Services

The App may, at the Company's discretion, utilize artificial intelligence technologies provided by third-party providers, including OpenAI and Anthropic, to analyze user-submitted food photographs and provide a general, non-personalized description of meal content. This feature is optional, may not be available to all users, and may be modified, limited, or discontinued at any time. AI-generated output may contain errors, may be incomplete, or may be inaccurate.

Users acknowledge that this feature does not provide medical, nutritional, or health advice, diagnosis, or personalized recommendations, and must not be relied upon as such. Final health-related decisions remain the sole responsibility of the user and their healthcare professionals.

Acceptable Use

Users agree not to:

Violate any law or regulation
Upload malicious software
Attempt unauthorized access
Interfere with App operation
Impersonate another person
Share another person's personal information without authorization
Use the App for unlawful purposes

OO WELL™ may suspend or terminate accounts involved in prohibited activities.

Intellectual Property

All content, software, designs, trademarks, branding, graphics, text, databases, workflows, methodologies, and materials available through the App are owned by or licensed to PURENUTRITION SRL. The OO WELL™ name, logo, and branding are protected trademarks and intellectual property.

Users may not copy, modify, distribute, reproduce, reverse engineer, or commercially exploit any part of the App without prior written permission.

Third-Party Services

The App may utilize third-party service providers including analytics, artificial intelligence, hosting, communication, and infrastructure providers. OO WELL™ is not responsible for the independent actions, policies, or services of third-party providers. Use of the App via the Apple App Store or Google Play is additionally subject to the respective platform's own terms of service.

Availability of Services

OO WELL™ does not guarantee uninterrupted availability of the App. The App may experience maintenance periods, service interruptions, technical failures, or security incidents. Services are provided on an "as available" basis.

Limitation of Liability

To the maximum extent permitted by law, PURENUTRITION SRL, its directors, employees, specialists, contractors, and affiliates shall not be liable for:

Indirect damages
Consequential damages
Loss of profits
Loss of data
Business interruption
Personal decisions made based on App content

Users assume full responsibility for actions taken based on information provided through the App.

Indemnification

Users agree to indemnify and hold harmless PURENUTRITION SRL, its officers, employees, specialists, and affiliates from claims, losses, damages, liabilities, and expenses arising from: violation of these Terms; misuse of the App; violation of applicable laws; or user-provided content.

Account Deletion and Termination

Users may request account deletion directly through the App. Users may also request account and data deletion without using the App, by visiting: livelongoowell.com/delete-account, or by emailing info@oowell.health. Submitting a deletion request will begin the account deletion process in accordance with the Privacy Policy. Users may also stop using the App and end this agreement at any time by ceasing use and requesting account deletion. OO WELL™ may suspend or terminate accounts for violations of these Terms.

Data Protection

The collection and processing of personal information are governed by the OO WELL™ Privacy Policy. By using the App, users acknowledge and agree to the Privacy Policy.

Apple App Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply and take precedence over any conflicting terms in these Terms:

This agreement is concluded solely between you and PURENUTRITION SRL, and not with Apple Inc. ("Apple"). PURENUTRITION SRL, not Apple, is solely responsible for the App and its content.
The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store's Usage Rules.
Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App, including but not limited to product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
In the event of any third-party claim that the App infringes that third party's intellectual property rights, PURENUTRITION SRL, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with any applicable third-party terms of agreement (for example, your mobile device or network provider's terms of service) when using the App.

Google Play Terms

If you downloaded the App from Google Play, your use of the App is additionally subject to the Google Play Terms of Service. Nothing in these Terms limits any rights you may have under Google Play's own terms and policies.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Moldova. Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of the Republic of Moldova.

Changes to These Terms

OO WELL™ may update these Terms from time to time. Updated versions will be published on the website and/or within the App. Continued use of the App after updates become effective constitutes acceptance of the revised Terms.
